Terms of Service

Effective May 17, 2026

These Terms of Service form a binding agreement between you and the team operating CrazySound.ai (“CrazySound,” “we,” “us”) and govern your access to and use of the CrazySound.ai website, APIs, and audio generation services (collectively, the “Service”). By creating an account, generating audio, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Read these carefully. Section 14 contains a binding arbitration clause and a class-action waiver that affect how you can bring legal claims against us.

1. Eligibility and account

You must be at least 18 years old and have the legal capacity to enter into a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” means both you and that organization. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.

2. The Service

CrazySound provides AI-assisted tools to generate audio assets including but not limited to radio commercials, Spotify ads, business phone and IVR greetings, and audio dubbing in supported languages. We may add, modify, or remove features at any time. We will provide reasonable advance notice before materially degrading core paid functionality.

3. Payment and billing

The Service is sold on a pay-per-project basis. Prices are displayed in your locale's currency on the pricing pages and at checkout. Payments are processed by a PCI DSS Level 1 third-party payment processor. By providing payment information you authorize CrazySound (via our processor) to charge the listed amount plus any applicable taxes.

3.1 All sales final

All purchases are final. Generated audio outputs, credit bundles, and subscription fees are non-refundable. Two reasons: (a) the third-party AI inference fees we pay to render your audio are incurred at the moment of generation, and (b) finished audio delivered to you can be reused indefinitely, so a refund-after- delivery model would invite abuse. If you cancel a subscription, you keep access through the end of the current billing period and you are not charged for the next; the unused portion of a prepaid period is not refunded.

If you believe a charge is fraudulent, unauthorized, or in error, contact billing@crazysound.ai and we will investigate in good faith. This is the only path to a refund and is reserved for legitimate billing disputes, not change-of-mind cancellations.

3.2 Taxes

Prices are exclusive of applicable taxes (VAT, GST, sales tax) unless stated otherwise. We collect the taxes required by your billing country and remit them as legally required.

4. Your content and your outputs

“Customer Content” means any prompt, script, business description, voice selection, custom recording text, audio file you upload (for dubbing), or other input you submit to the Service. “Outputs” means the audio files, transcripts, and other artifacts the Service generates in response to your Customer Content.

  • You retain all rights, title, and interest in your Customer Content. You grant CrazySound a non-exclusive, worldwide, royalty-free license to host, process, transmit, and modify your Customer Content solely to operate the Service for you (including sending it to the AI subprocessors listed in our Privacy Policy).
  • Subject to your payment of applicable fees and your compliance with these Terms and the Acceptable Use Policy, you own all Outputs generated for you and may use them commercially, including in broadcast and streaming inventory.
  • You are solely responsible for ensuring you have the legal rights to any brand name, business name, product name, person's name, trademark, copyrighted material, or other third-party element you include in a prompt or upload to the Service. CrazySound does not pre-screen prompts and does not represent that Outputs are clear of third-party claims.

5. AI-generated content disclaimer

Outputs may be inaccurate. The Service uses third-party large language models, text-to-speech systems, and music-generation systems whose behavior is probabilistic. Outputs may contain factual errors, mispronunciations, or other inaccuracies and may differ from prompt instructions. Always review Outputs before broadcast, publication, or distribution to ensure accuracy and suitability for your use case.

Without limiting the foregoing, the Service is not a substitute for professional legal, medical, financial, or other regulated advice; Outputs that touch on regulated subject matter must be reviewed by appropriate professionals before use. CrazySound is not responsible for any claims, damages, or losses arising from your use of Outputs without such review.

6. Acceptable use

Your use of the Service is also governed by our Acceptable Use Policy, which is incorporated by reference. Violations may result in immediate suspension or termination of your account without refund.

7. Intellectual property

The Service itself — including our software, brand assets, UI designs, prompt engineering, voice catalog naming, and accompanying documentation — is owned by CrazySound and protected by intellectual property law. These Terms do not grant you any rights to our trademarks, logos, or branding except for the limited license to identify CrazySound as the provider of the Service.

8. Feedback

If you send us suggestions, ideas, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction. You waive any moral rights in feedback to the extent allowed by law.

9. Confidentiality

Each party may receive information about the other that is confidential. The receiving party will use the same care to protect confidential information as it uses to protect its own, but not less than reasonable care, and will use it only to perform under these Terms. This section does not apply to information that is publicly available, independently developed, or rightfully received from a third party without a duty of confidentiality.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. CrazySound does not warrant that the Service will be uninterrupted, error-free, secure, or that Outputs will meet your requirements. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our liability is limited to the maximum extent permitted by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CRAZYSOUND OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL CRAZYSOUND'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO CRAZYSOUND IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED US DOLLARS (US $100).

12. Indemnification

You will defend, indemnify, and hold harmless CrazySound and its affiliates from and against any third-party claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Customer Content; (b) your use of Outputs in violation of these Terms or applicable law; (c) your violation of the Acceptable Use Policy; or (d) your violation of any third party's rights, including intellectual property rights.

13. Term and termination

These Terms remain in effect while you have an account. Either party may terminate at any time. You may delete your account from the settings page or by emailing support@crazysound.ai. We may suspend or terminate your account immediately and without notice if we reasonably believe you have violated these Terms or the Acceptable Use Policy. Sections 4 (your retained content rights), 5 (AI disclaimer), 7–12 (IP, confidentiality, disclaimers, liability, indemnification), and 14–17 (dispute resolution, governing law, miscellaneous) survive termination.

14. Dispute resolution — arbitration and class-action waiver

Most concerns can be resolved by emailing legal@crazysound.ai. If we cannot resolve a dispute informally within 60 days, you and CrazySound agree to resolve the dispute by binding arbitration administered by JAMS under its Streamlined Arbitration Rules in San Francisco, California (or, at your election, in your home county if you are a US consumer). The arbitrator's decision is final.

Class-action waiver. You and CrazySound each agree that disputes will be resolved on an individual basis only and not as a class, representative, or consolidated action.

Small-claims carve-out. Either party may bring an individual claim in small-claims court if it qualifies.

Opt-out. You may opt out of this arbitration clause by emailing legal@crazysound.aiwithin 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out.” Opting out has no other effect on your relationship with CrazySound.

15. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute not subject to arbitration will be heard exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

16. Changes to these Terms

We may revise these Terms from time to time. When we make material changes we will notify you by email or in-product notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance.

17. Miscellaneous

These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and any Order Form or DPA executed between us, are the entire agreement between you and CrazySound about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
